Terms of Service

1. Acceptance of These Terms

These Terms of Service (“Terms”) form a binding agreement between you and GOOSE SOCIAL, LLC (“GOOSE SOCIAL,” “we,” “us,” or “our”), a limited liability company formed in the State of Wyoming, United States. They govern your use of the PopBox application (“PopBox” or the “App”) and the website at https://popbox.video (the “Site”).

By downloading, installing, or using PopBox, you agree to these Terms. If you do not agree, do not use the App.

2. Description of the Service

PopBox is a native video player for Apple platforms, including iPhone (iOS), iPad (iPadOS), Mac (macOS), and Apple TV (tvOS). PopBox plays your own video files and connects to media servers and sources that you choose and control, including providers such as Plex, SMB, FTP, and Xtream, and similar sources.

We provide software only. We do not host, provide, stream, or sell any video content. You supply all content, all servers, and all credentials. You do not need to create an account with us or give us an email to use the App.

3. License Grant

Subject to these Terms, GOOSE SOCIAL grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use PopBox on Apple-branded devices that you own or control, for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to derive the source code of the App, except to the extent that applicable law permits.

4. Apple Licensed Application End User License Agreement

PopBox is distributed through the Apple App Store. If we do not provide a separate, custom end user license agreement, your license to use PopBox is governed by the standard Licensed Application End User License Agreement published by Apple, which is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, as supplemented by these Terms. To the extent of any conflict, these Terms control for matters they address, except where the Apple standard agreement is required to govern.

The following acknowledgements apply because PopBox is licensed through the App Store:

  • This agreement is between you and GOOSE SOCIAL, LLC only, and not with Apple. Apple is not a party to these Terms.
  • GOOSE SOCIAL, LLC, and not Apple, is solely responsible for PopBox and its content.
  • Apple has no obligation to furnish any maintenance or support services for PopBox.
  • In the event of any failure of PopBox to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to PopBox.
  • GOOSE SOCIAL, LLC, and not Apple, is responsible for addressing any claims by you or any third party relating to PopBox or your possession or use of it, including product liability claims, claims that PopBox fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws.
  • GOOSE SOCIAL, LLC, and not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that PopBox or your possession and use of it infringes that third party’s intellectual property rights.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

5. Subscriptions and Purchases

PopBox uses a freemium model. A free tier is available with limits. PopBox Pro can be unlocked through Apple In-App Purchase using Apple StoreKit. The available products are:

  • PopBox Pro Monthly: an auto-renewable subscription at $1.99 per month, with a 30-day free trial as an introductory offer.
  • PopBox Pro Yearly: an auto-renewable subscription at $16.99 per year, with a 30-day free trial.
  • PopBox Pro Lifetime: a one-time, non-consumable purchase at $99.99, with no trial, granting a permanent unlock.

The Monthly and Yearly subscriptions belong to the same subscription group. The Lifetime purchase overrides the subscriptions.

5.1 Auto-Renewable Subscription Terms

The following terms apply to PopBox Pro Monthly and PopBox Pro Yearly:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • The subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period, at the rate of the selected plan.
  • You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase.
  • If a free trial is offered, any unused portion of the trial period is forfeited when you purchase a PopBox Pro subscription, where applicable.

5.2 Lifetime Purchase

PopBox Pro Lifetime is a one-time, non-consumable purchase. It does not renew and is not a subscription. It grants a permanent unlock tied to your Apple ID.

5.3 Payments and Refunds

Apple processes all payments. We do not collect or store your payment card data. Apple ties your purchase to your Apple ID. Refunds are handled by Apple in accordance with Apple’s policies. To request a refund, contact Apple through your Apple ID account.

6. Acceptable Use and User Responsibilities

PopBox is a player for your own content and your own servers. You are solely responsible for:

  • The content you access through the App, and for having all rights necessary to access and play it.
  • The servers, sources, and accounts you connect to, and for your own credentials.
  • Complying with all applicable laws when using the App.

You agree not to use PopBox to infringe any copyright or other intellectual property right, to access content you are not authorized to access, or to violate any law. We do not provide content, and we are not responsible for the content available on the servers and sources you choose to connect to.

7. Intellectual Property

PopBox, including the App software, its design, the “PopBox” name, and related branding, is owned by GOOSE SOCIAL, LLC and is protected by intellectual property laws. These Terms do not grant you any right in our trademarks, logos, or other branding. All rights not expressly granted to you are reserved.

8. Disclaimer of Warranties

PopBox is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with every server, source, or file format, or that it will meet your requirements.

You use the App, and connect to your own servers and sources, at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, GOOSE SOCIAL, LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of or inability to use PopBox, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for all claims relating to the App will not exceed the amount you paid to Apple for the App in the twelve months before the event giving rise to the liability, or, if greater is not permitted, the minimum amount required by applicable law.

10. Indemnification

You agree to indemnify and hold harmless GOOSE SOCIAL, LLC and its members, managers, and affiliates from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the App, the content and servers you connect to, your violation of these Terms, or your violation of any law or third-party right.

11. Termination

These Terms remain in effect while you use PopBox. We may suspend or terminate your license if you breach these Terms. You may end this agreement at any time by ceasing to use the App and deleting it from your devices. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, survive.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute arising out of or relating to these Terms or the App lies in the state or federal courts located in the State of Wyoming, and you consent to the jurisdiction of those courts, except where applicable law provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the dates shown for this document. Material changes will be reflected here, and your continued use of the App or Site after an update means you accept the revised Terms.
